All materials found on the Neptune Nautica website are the exclusive intellectual property of Neptune Nautica Jdoo and may be used only with the express permission of the copyright holder, trademark and/or design rights holder. Neptune Nautika jdoo enables the use of the services and content of the Neptune Nautica website as regulated by these Terms of Purchase (Pre-Contractual Notices).
These Purchase Terms (Pre-Contractual Notices) are part of the Seller’s obligation in accordance with the provisions of the Consumer Protection Act, and serve to ensure that the Buyer, before entering into a distance contract, is informed in a clear and comprehensible manner about a series of circumstances that are essential for the conclusion, execution, termination of the contract, and all in accordance with the law.
The term Seller therefore refers to the company Neptune Nautika jdoo
The term Customer primarily refers to a classic consumer protected by the Consumer Protection Act, i.e. a natural person who, outside of any activity, orders and pays for any product through the web trade services available on the Seller’s website, but also to artisan buyers, individual traders, natural and legal persons who perform business activities, and who are protected by the provisions of the Consumer Protection Act only if they purchase products unrelated to their business activities, and to all other customers.
By selling through the Neptune Nautica jdoo website, the seller acts on his own behalf.
The conditions of purchase (pre-contractual notices) form part of the contract concluded at a distance together with the specifications and price(s) of the purchased product(s), and before confirming the order for the purchase of an individual product, the Buyer will be asked to accept/declare that he/she is familiar with/agree with them, while after confirming the order (conclusion of the contract), they will be delivered to the Buyer as the content of an e-mail message confirming that the contract has been concluded. The seller reserves the right to change the conditions of business and use of these pages at any time, with the said changes coming into force after publication on these websites.
It is considered that by accessing the pages, the user is familiar with the current rules and terms of use of the same, and confirms this when confirming the purchase.
When the Buyer confirms and executes the order, the contract is concluded, and the Seller will immediately notify the fact of the conclusion of the contract by e-mail that the contract has been concluded.
For a validly concluded contract, it is necessary that the Buyer is a person with full business capacity.
The customer is responsible for the completeness and truthfulness of the data entered during registration.
The terms of purchase (Pre-contractual notices) are divided into categories/information classified below.
Access to the Neptune Nautica website may sometimes be unavailable due to work, maintenance or the introduction of new content and in cases of unforeseen circumstances beyond the Seller’s control, which the Seller will endeavor to remove as soon as possible.
Neptune Nautika jdoo fully disclaims any responsibility that may arise from, or is in any way related to, the use of these web pages, for any actions by the user using or abusing the content of these web pages, and for any damage that may occur to the user or any third party and is related to the use or misuse of the content of these web pages. The user has the right to buy products on the website of neptune nautica and to use them in good faith and in good faith.
Neptune Nautika jdoo strives to keep the product information accurate and up-to-date, but it is free from possible errors in the published information, Neptune Nautika jdoo assumes no responsibility or liability for any errors or omissions in the content on these websites, as well as for the accuracy of the published information. That is, it is not responsible for occasional non-functioning of pages or their parts. Photos and images on these pages and the pages of partners do not necessarily correspond to the products that are actually available, some photos may be typical for a certain type of product.
Main characteristics of the goods
The main characteristics of the goods: the products are shown descriptively and with photos.
Product photos are illustrative in nature, and may not always correspond in all details to the products that are the subject of the order. The seller especially points out that the visual identity of the product shown in the photo does not have to correspond to the appearance of the product in reality, especially considering the monitor settings on the customer’s computer, differences in the perception of colors as the customer sees them on the screen, etc. In the case of the above-mentioned discrepancy between the product shown in the photo and the delivered product, it is not a lack of product.
Product data (product description, price, etc.) displayed on the Neptune Nautica website are subject to bugs, irregularities in the operation of the application, other technical irregularities, typographical errors, etc. In the event of obvious errors or inaccuracies in the product data displayed on Neptune Nautica, the seller reserves the right to unilaterally terminate the contract.
The subject of the order can only be products for which it is indicated in the order that they are available, it may happen that the information about the availability of the product is not the same as the state in the warehouse.
If the ordered product is not available in the warehouse, the Seller will inform the Customer that the product is currently not available, the time frame in which the product is available, and at the same time offer the possibility of purchasing an alternative product from our web store that is available for delivery and that is closest in terms of its characteristics to the product that cannot be delivered.
Product price
The prices displayed on the Neptune Nautica website are expressed in euros with VAT, as the cost of VAT is included in the price of the product. Delivery costs are not included in the product prices and for this reason they are paid separately, all in accordance with the conditions and in the manner indicated in these Terms of Purchase (Pre-Contractual Notices) and when ordering the item. The offer and prices for the products on sale are valid until the end of the sale period or until the stock runs out.
Before confirming the order, the price of the product, which includes VAT, the price of delivery if it is chargeable, and the final price are shown separately so that the customer has an overview of the final price he pays for the ordered purchase service.
In case of payment by e-banking and general money order, payment costs and/or interbank transactions are not included in the price.
Shipping costs
Delivery is made via the delivery service to the address you specified during purchase (please note that during purchase you can define a delivery address different from the address that will be on the invoice). Since the delivery is made via a delivery service within the European Union, the cost of delivery itself is variable depending on the weight, dimensions and place of delivery. The delivery price is communicated to the customer when creating the purchase order for all products in the shopping cart before the order is confirmed.
In case of impossibility of proper delivery to the address indicated by the Buyer, the Buyer shall bear the costs of re-delivery to the same or a different address, depending on what information the Buyer will provide to the Seller when checking the delivery of the order.
We aim to process and ship orders promptly, subject to product availability and any unforeseen circumstances. Delivery time may vary depending on your location and shipping method selected. Neptune Nautika jdoo is not responsible for any delays or failures in delivery caused by events beyond our reasonable control, including but not limited to natural disasters, shipping strikes or customs clearance procedures.
When picking up the ordered shipment, the user is obliged to identify himself to the delivery service employee, check for possible damage to the shipment and, in the case of correctness of the shipment, sign the delivery note confirming receipt of the shipment. In case of damage to the shipment, the user is obliged to report the shipment to the delivery service employee immediately. Neptune Nautika jdoo disclaims any responsibility for damages that may occur from the moment the shipment is handed over to the delivery service until the moment it is delivered to the user.
Costs of using means of distance communication
The seller does not have any additional costs for means of remote communication.

Terms and conditions
These conditions apply to persons of legal age and legal capacity residing in the territory of the European Union. By ordering and sending the order, you fully agree to the stated conditions.
All prices are in euros and include VAT. In the event of an incorrect price, we reserve the right to change it with prior notice to the buyer. There may be minor differences in the appearance of the product compared to its image (we have tried to note these differences in the product description).

In our web store, it is possible to view and order all products from the offered assortment. You can order products as a registered or unregistered customer. If you register before (or during the purchase), you allow us to send our promotional letter to your e-mail address with the latest offers and benefits that we offer to our customers. To access certain features of our website or to make purchases, you may need to create an account. You agree to provide accurate and complete information during the registration process and to update that information immediately if it changes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Products are ordered by selecting, using the menu and filling out an electronic form. A product is considered ordered when the customer completes the entire ordering process.
Order process
- After viewing the product, enter the desired quantity in the window (you can change the quantity later) and click on the text “Add to cart”. It will open a dialog where you can complete or continue with the purchase. Click on “Complete purchase”.
- If you want to change the quantity of a product, enter the change in the window next to the product in the “Quantity” column and click update cart.
- If you have finished your selection, you can continue by clicking on «Checkout» or if you want to add another product, click on «Continue shopping» and select a new product and repeat the first 2 steps for each product.
- If you want to remove a product from the cart, click on the X to the left of that product and it will disappear from the list.
- If you have a coupon for an additional discount, enter the code in the window provided for it.
- After you are satisfied with the contents of the Basket, click on «Checkout» to continue with the purchase process.
- If you have already registered before the purchase, enter your data (data entry in the fields marked with a red star is mandatory).
- If you did not register before the purchase or you are not a registered user at all, you will be offered three options for continuing the purchase.
- If you are registered, select the first option and enter your registration data. If you can’t remember your password, click on «Forgot password». After that, enter your username or e-mail and click on «Send password». A new password will be sent to your e-mail address immediately. You can now continue shopping.
- If you are not registered and want to register, choose another option. After the registration process, you continue with the purchase.
- If you want to make a purchase and do not want to register, choose the third option (in that case, you will have to enter some information about yourself, but they will not be saved in our database of registered users, but only serve once for that purchase).
- After verifying and entering additional information for the invoice, check the Shipping Address field if it is different from the address that should be on the invoice. Then enter the shipping address information.
- Choose a delivery method and a payment method. Shipping costs will be automatically added to the offer. You can make the payment by one-time card payment with debit or credit cards, to one of our transaction accounts by virmana, internet banking or general money order or upon delivery by cash on delivery. The invoice for your order will be delivered to you with the ordered products or via e-mail.
- Review the entire offer on the screen once again and enter any notes at the bottom of the offer (e.g. preferred time of day for delivery or something else).
- Click on “Place order”
- This completes the ordering process. An official offer will be sent to your e-mail address within 1 working day, according to which you can make a payment to one of our transaction accounts. If one of the products is not currently available, you will be contacted by phone or e-mail by our employees who will try to help you by recommending a replacement product or information about the availability of the missing product.
Registration process
By registering, you allow us to send you our promotional letter in which we inform you about the news and benefits we have for our clients. To access certain features of our website or to make purchases, you may need to create an account. You agree to provide accurate and complete information during the registration process and to update that information immediately if it changes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Payment method
By placing an order through our website, you agree to pay the price listed for the products selected, including all applicable taxes and shipping charges. All payments are processed securely through our authorized payment processor. Neptune Nautica reserves the right to refuse or cancel any order at its sole discretion, and we may request additional information or verification before accepting an order.
When making a purchase in our online store, you can choose from several payment methods:
- Payment according to the purchase order, i.e. offer via internet banking, wire transfer, general payment order or card. You pay according to the offer that you will receive to your e-mail address, and not according to the offer that will be displayed on your screen after the purchase is made, since the offer that you receive by e-mail has been checked and updated according to the state of the warehouse. The delivery price will be highlighted on the offer. You make the payment to our transaction account at Erste&Steiermärkische Bank dd., IBAN: HR9324020061101188429 and after the payment is visible on the statement, we send the products by delivery service within five working days if they are available in the warehouse or within a period of which we will notify you by e-mail if they are not available in the warehouse.
- Cash on delivery, i.e. payment on delivery when you pay the delivery service upon receipt of the delivery. Note: when paying on delivery, we ship the products immediately if they are available in stock or within the deadline we will notify you about by e-mail if they are not available in stock, and please note that the delivery service may also charge a fee for the cash on delivery service.
- Payment through our authorized payment processor with one-time credit or debit cards and additional payment methods (KeksPay, Aircash, GooglePay, Paycek)
In the event that payment is not made within the specified period, the Seller will proceed with the delivery of the purchased products even after the payment is made later than the deadline, and if the Seller is unable to make the delivery for justified reasons, the contract will be unilaterally terminated and the funds paid will be refunded.
If the payment has been properly made and is visible on the Seller’s account, the Seller will proceed with the delivery of the ordered products. The invoice for the order is delivered in the shipment together with the goods or via e-mail.
Neptune Nautica reserves the right to refuse or cancel any order at its sole discretion, and we may request additional information or verification before accepting an order.
Delivery terms
The ordered products are delivered to the territory of the European Union. Delivery is made through delivery services.
We deliver the goods (which are available at the warehouse) within 1 to 7 working days (working days are not Saturdays, Sundays and holidays) from the moment of receiving the payment (with the condition that the payment is recorded by 12 o’clock) where there is an organized delivery, directly to the specified address. Where delivery is not organized, the post office informs you of the arrival of the shipment, which you can pick up at the office of the delivery service or a parcel machine within 5 days.
If it is impossible to deliver the selected product because the product is no longer available, the Seller is obliged to inform the Buyer immediately, and the Buyer has the right to terminate the contract and request a refund or agree to a later delivery date. All ordered items will be endeavored to be delivered in one package. If this will not be possible due to the state of stock or the size of the product, the Seller reserves the right to deliver in multiple shipments.
Delivery is carried out in accordance with the terms of use of the delivery service, and is considered completed at the moment of handing over the product to the delivery service.
When picking up the ordered shipment, the user is obliged to identify himself to the delivery service employee, check for possible damage to the shipment and, in the case of correctness of the shipment, sign the delivery note confirming receipt of the shipment. In case of damage to the shipment, the user is obliged to report the shipment to the delivery service employee immediately. Neptune Nautika disclaims any responsibility for damages that may occur from the moment the shipment is handed over to the delivery service until the moment it is delivered to the user.
When the Seller delivers the product to the Buyer through the delivery service, the Buyer is obliged to accept it by signing the delivery note, thereby confirming that the product has been properly delivered.
In the event that the Buyer orders the goods and refuses to receive them, the Seller has the right to withhold from the paid amount of the purchase price the amount equal to the delivery costs and other manipulative costs from the delivery price list.
Delivery deadlines do not include:
- day of order/request receipt
- delay time due to incorrect and incomplete address of the Customer
- time of delay due to force majeure or other reasons for which the Seller is not to blame
- non-working days
In the event that the ordered product is paid for by cash on delivery, the Seller will start the delivery of the goods according to the above-mentioned deadlines that run from the confirmation of the order, and the Buyer is obliged to make the payment when or immediately before taking over the product.
Data privacy
Your data, which you voluntarily provide during the registration process, will be used during the purchase process and for sending promotional letters and other informational materials that we provide to our clients. By registering, you agree to this practice. The data you give us during an anonymous purchase will not be stored for further use.
We protect your personal data in accordance with the regulation on the protection of personal data. You have the right to request the correction, amendment or addition of incomplete or unupdated data, and if you do not want to receive informative data from us, you can request it by e-mail or by phone.
Neptune Nautica undertakes to provide protection to customers’ personal data, in such a way that it collects only necessary, basic data about customers/users that are necessary for the fulfillment of our obligations; informs customers about the use of collected data, regularly gives customers the opportunity to choose about the use of their data, including the ability to decide whether or not they want their name removed from lists used for marketing campaigns. All user data is strictly kept and is available only to employees who need this data to perform their work. All employees of Neptune Nautica and business partners are responsible for respecting the principles of privacy protection.
Warranty and service
All products offered on the Neptune Nautica website are covered by a manufacturer’s warranty, with the exception of goods that fall into the category of consumer goods. Warranty conditions for products are determined by the manufacturer and as such are transferred to Neptune Nautica users.
All products are thoroughly inspected before being handed over to the delivery service and delivered in good condition. If upon receipt the user notices damage caused during transport, they are obliged to contact Navtronik immediately and report the damage by phone or e-mail.
If during the first use you find that the delivered device is defective, please contact us as soon as possible so that we can replace it with a correct device as soon as possible.
The suppliers of the products offered on the Neptune Nautica website provide service in accordance with the legal regulations of the Republic of Croatia
Unilateral termination of contract
Only the Buyer who concluded the Distance Contract in the manner described above has the right, without giving reasons, to unilaterally terminate the contract within 14 days. The period of 14 days begins to run from the day when the goods that are the subject of the contract are handed over to the Buyer or a third party designated by the Buyer, who is not the carrier/delivery person. If with one order the Customer has ordered several pieces of goods that should be delivered separately, i.e. if it is a question of goods that are delivered in several pieces or in several shipments, the deadline begins to run from the day when the last piece or the last shipment of goods is handed over to the possession.
To exercise this right, it is necessary to send the undamaged and unused product in its original packaging with all accessories and documentation with which the product was originally delivered. The costs of shipping the product to Neptune Nautika are borne by the buyer.
If the Seller does not notify the Buyer of this right, the Buyer’s right to unilateral termination of the contract ends within 12 months from the expiration of the termination period (the 12-month period begins after the expiration of the 14-day period provided for regular termination in case of proper notification). If, on the other hand, the notification of the right to unilateral termination is delivered within 12 months, the right to unilateral termination ends after the expiry of the period of 14 days from the day the Customer receives the notification.
Before the expiration of the term for unilateral termination, the buyer is obliged to notify the seller of his decision to terminate the contract by means of the Form for unilateral termination of the contract , which he can fill out and send to the email address [email protected] or by post to the address of the seller Neptune Nautika jdoo, Jagorika 41, 51521 Punat. Confirmation of receipt of notification of unilateral termination of the contract will be delivered by the Seller, without delay, electronically.
Refund
If you unilaterally terminate this Agreement, we will refund the money we received from you, without delay, and no later than 14 days from the day we received your decision to unilaterally terminate the Agreement. The costs of returning the goods are borne by the Buyer. The refund will be made in the same way as you made the payment. We can only refund the money after the goods have been returned to us and inspected. You are obliged to return the goods to us immediately, and no later than 14 days from the day you sent us your decision to unilaterally terminate the Agreement.
Return the goods in person or by mail in a verifiable manner to the address Neptune Nautika jdoo, Jagorika 41, 51521 Punat. It is considered that you have fulfilled your obligation on time if you send the goods to us personally in our warehouse in a demonstrable way (by registered mail) before the expiration of the aforementioned period.
The user also acquires the right to a refund if he does not want a replacement product, and the goods were not delivered in accordance with the order, the delivered goods do not correspond to the manufacturer’s specifications, if there was damage during delivery and if there are doubts about the healthiness of the product.
You are responsible for any reduction in the value of the goods resulting from the handling of the goods, except that which was necessary to determine the nature, characteristics and functionality of the goods. If the product is returned defective, with major damages or without parts and documentation, and if the same is not delivered within a subsequent period of 8 days, it is considered that the Buyer has not fulfilled his obligation to return the goods, and the Seller is not obliged to return the funds paid.
The customer does not have the right to unilaterally terminate the contract if:
- the service contract was fully fulfilled by the Seller, and the fulfillment began with the explicit prior consent of the Buyer, and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the contract from this section if the service is fully fulfilled;
- the subject of the contract is goods or services whose price depends on changes in the financial market that are beyond the influence of the Seller, and which may appear during the duration of the Buyer’s right to unilaterally terminate the contract;
- the subject of the contract is goods that are manufactured according to the Buyer’s specifications or that are clearly customized for the Buyer;
- the subject of the contract is easily perishable goods or goods that quickly expire;
- the subject of the contract is sealed goods that are not suitable for return, if they were unsealed after delivery;
- the object of the contract is goods which, due to their nature, are inseparably mixed with other things after delivery;
- the subject of the contract is the delivery of goods, the price of which is agreed at the time of signing the contract, and the delivery can only take place after 30 days, if the price depends on changes in the market that are beyond the trader’s influence;
- If the buyer has specifically requested a visit from the Seller to carry out emergency repairs or maintenance work, with the proviso that if during such a visit, in addition to the services that the Buyer expressly requested, the Seller also provides some other services, i.e. delivers some other goods other than those necessary for emergency repairs or maintenance work, the Seller has the right to unilaterally terminate the contract in connection with those additional services or goods;
- the subject of the contract is the delivery of sealed audio or video recordings, or computer programs, which were unsealed after delivery;
- the subject of the contract is delivery of newspapers, periodicals or magazines, with the exception of subscription contracts for such publications;
- contract concluded at a public auction;
- the subject of the contract is the provision of accommodation services that are not intended for housing, the provision of goods transportation services, vehicle rental services, food and beverage delivery services or leisure-related services, if it is agreed that the service will be provided on a specific date or in a specific period;
- the subject of the contract is the delivery of digital content that was not delivered on a physical medium if the fulfillment of the contract began with the express prior consent of the Buyer and with his confirmation that he is aware of the fact that he will thereby lose the right to unilaterally terminate the contract;
Liability for material defects / Complaints
The seller is responsible for material defects of the items he sells on his website in accordance with the positive regulations of the Republic of Croatia, especially the Law on Obligations.
Ordered products are packaged in such a way that they are not damaged by normal handling during transport/delivery.
In the event that the shipment is damaged in transit, such damage is visible upon receipt of the shipment, and in such a case we suggest that the Buyer not accept the shipment. We ask the Buyer to contact us so that we can check the condition of the shipment and send a new one as soon as possible.
When receiving the goods, checking the correctness of the order depends on the buyer, so the buyer is obliged to compare the received items with the invoice, if something is missing, he is obliged to send a written complaint/complaint immediately, as subsequent complaints will not be accepted.
In the event of a visible lack of product when taking over the shipment, the Buyer is not obliged to take over the delivered product, may refuse receipt, and does not bear the costs of delivery of such product.
It is considered that the products that were duly received by the Customer had no visible defect.
The buyer has the right to make a complaint regarding material defects within the deadlines and for reasons prescribed by the provisions of the Law on Mandatory Deadlines. The buyer can send a written complaint or claim to the e-mail [email protected] or by mail to the seller’s address: Neptune Nautika jdoo, Jagorika 41, 51521 Punat, with the indication Complaint. In the event of inability to deliver a written form, the complaint can be reported by phone at the phone number: +385 51 583 240. The complaint should contain: a) the name of the item, b) a short description of the complaint, d) the number of items to which the complaint applies.
Complaints submitted will be processed in the shortest possible time. Also, in order to determine as quickly as possible the specific order to which the Buyer has an objection, Buyers are asked to indicate the order number, account number or their username in the objection.
The customer has the right to a justified complaint and to return the goods in the following cases:
- if the goods are not delivered in accordance with the order
- if the delivered goods do not correspond to the manufacturer’s specifications
- if there was damage during delivery
- if there is any doubt about the healthiness of the product
If, during delivery, the recipient discovers damage to the shipment, he is obliged to draw up a report on the condition of the goods in the shipment, which is certified by the joint recipient and the driver, and such a document can be the basis for compensation for damage.
If the product has a hidden defect (a defect that could not be detected by a normal inspection upon receipt of the item) which the Buyer determines upon opening the product – the Buyer has the right to unilaterally terminate the contract and request a refund, as well as a replacement of the product.
Otherwise, the seller will consider the complaint valid if, after examining the product, he determines that it meets the conditions for a complaint in accordance with the Law on Obligatory Relations and the Law on Consumer Protection. In that case, within 15 days of receiving a valid complaint, they will replace the product or return the entire paid amount with termination of the contract. If, on the other hand, he finds that the complaint is not valid, i.e. if it rejects the complaint, it will inform the Buyer about the same within 15 days from the day of receipt of the complaint, and return the goods at the expense of the Buyer.
The seller will accept the return of damaged, defective or wrongly delivered goods at his own expense, if it is determined that the complaint is justified, and that the buyer has not affected the correctness, damage or any defect of the goods.
In the event of a justified complaint, the cost of replacement with a new product is fully borne by the Seller.
To the fullest extent permitted by law, Neptune Nautika will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of our website or products purchased from us, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount paid by you for the products in question.
Online dispute resolution
According to a special regulation of the European Union, from February 15, 2016, disputes related to online purchases can be resolved throughout the EU via a platform that you can access here : https://ec.europa.eu/consumers/odr/main/index.cfm
This means that if you encounter a problem during an online purchase within the EU (defective product, inability to exchange the product, etc.), you can submit your complaint at the above link.
The platform can be used by both consumers and traders, and complaints can be submitted in any of the 23 official languages of the EU.

Contract duration
The contract that the Buyer concludes with the Seller is a one-time contract for the purchase and sale of products at a distance, which is concluded by the delivery of the goods and the payment made by the buyer, in case it is not terminated. These Terms of Purchase (Pre-Contractual Notices) are an integral part of the contract.
Privacy and data security statement

POSAM is closed on public holidays and public holidays. Disposal of EE waste at the POSAM landfill is completely free for you.

All payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in other currencies into EUR according to the current exchange rate of the Croatian National Bank.
